PS cares about your privacy. Therefore, we always strive to protect your personal data in the best possible way and to comply with all applicable laws and regulations for the protection of personal data. In this policy, we want to inform you about how PS collects and processes your personal data.

This Privacy and Cookie Statement applies to PS Auction AB, (”PS Auction”). PS Auction AB is a brand name of TBAuctions Netherlands B.V. (hereinafter 'TBAuctions). For an overview of the brands of TBAuctions, visit www.tbauctions.com

If you are a customer, visit our website or have contact with our customer service, you share your personal data with us. You can think of your name, phone number or email address. These are all data that we can relate to you. We therefore make every effort to process your personal data carefully. In this Privacy Statement you can read how PS Auction handles your personal data.

This Privacy Statement applies to all personal data processed by PS Auction from anyone using our services, website (psauction.com) or other applications and mobile platforms ("Platform"), such as our visitors, bidders, sellers and buyers. The policy also applies if you have a user account on our website as well as if you represent a seller, buyer or bidder, for example when the seller, buyer or bidder is a company, and you are acting as the company’s contact person. These personal data are processed in accordance with applicable data protection legislation, more specifically the EU Regulation 2016/679, also known as the General Data Protection Regulation (GDPR), as well as any other future legislation and additional national legislation.

This Privacy Statement also explains how you can request us to modify, limit or remove your data. In addition, you have the right to withdraw your consent, the right to object, the right to data portability and the right to access. PS Auction will do its utmost to keep your personal information correct and up-to-date. For this we need your help. Have your personal data changed? 2. Who is responsible for processing your data?

PS Auction AB is a private company under Swedish law, established on Argongatan 6, 43153 Mölndal, Sweden, with registration number 556632-1468.

For the purposes described in this Privacy and Cookie Statement ("Statement"), the above company is considered "data controller", who determines the means and purposes for the collection, storage, disclosure, use and other types of processing of personal data.

Any reference to "we," "us" or "our" in this Statement shall refer to PS Auction AB.

 

3. What is personal data?

Personal data is any data that we can relate to you. These include your name, address, postcode, place of residence, telephone number or e-mail address. But also, data like your IP-address and IBAN-number are personal data. And other information that is unique to you, like your PS Auction bid data or purchase history.

 

4. What personal data do we process from you?

As part of creating an account, PS Auction collects personal data necessary to provide you with services and to execute the agreement with you. The personal data that we process is the data that you have provided us with or that we collect from you when you visit the website or from a third party.

To create a private account, we collect and process at least the following (personal) data from you:

  • Gender (Mr./Mrs.)
  • First name and surname
  • Address, postal code and city
  • Country
  • E-mail address
  • (Mobile) phone (for SMS verification)
  • Social security number (Personnummer)
  • Date of birth

To create a business account, we collect and process the following (personal) data from you:

  • First name and surname
  • Company name
  • Address, postal code, town
  • Country
  • E-mail address
  • (Mobile) phone/fax number (for SMS verification)
  • Organisation number
  • VAT number
  • TIN number

To create a business account as a client (seller), we collect and process the following (personal) data from you:

  • First name and surname
  • Company name
  • Address, postal code, town
  • Country
  • E-mail address
  • (Mobile) phone number
  • vat number
  • TIN number
  • Bankgiro, Plusgiro, Bank account number

For bids and for managing the website and content we collect and process the following (personal) data from you:

  • Technical and anonymized data
  • Your feedback on the use of our Platform and any other information you send us via the functionalities of the Platform, which enables us to improve the functionalities of our website and Platform
  • Anonymous data that cannot be traced back to a person, for reporting purposes.

For successful bids and purchases we collect and process the following (personal) data from you:

  • Purchased lot information
  • Payment methods and when the payment is made

We require digital identification of our Swedish customers via BankID to create new accounts.
 

5. What is the purpose of processing personal data and based on what legal basis is your personal data processed??

PS Auction may collect, process and store your personal data within certain limits to ensure that PS Auction can continue to function optimally. These processes are based on various legal grounds, depending on the concrete circumstances. We handle your personal data with care and take both technical and organizational measures to protect them.

PS Auction processes and uses your (personal) data for the following purposes:

Concluding and executing an agreement

PS Auction needs certain personal data from you to enter into an agreement with you and to properly execute and settle it (delivery). Without these data we are not able to build a relationship with you or to execute an agreement.

To manage your purchase, we also process your personal data for the following reasons:

  • To provide online auction services
  • Register and close bids on auctions
  • Inform participants about an auction and its progress
  • In case of technical problems, to solve them to track your bid on an item and prevent that your bid is lost due to a technical problem
  • To carry out our administration
  • To allow you to collect goods or to have the delivery service send the purchased goods to you
  • Prepare and issue invoices

The necessary data are collected during the registration process of your account and further during the relationship between you and PS Auction. PS Auction processes the following personal data for this purpose:

  • Name and (delivery) address details
  • Email address
  • (Mobile) phone number

Relevant communication

Purpose: To communicate relevant information to you, including to:

  • Provide information to sellers and/or customers as part of an auction and/or a third party involved in conducting auctions
  • To inform you about functional changes in the terms, this policy and to give you important information about e.g. the auctions you participate in

Personal data: PS Auction processes the following personal data for this purpose, namely your contact details.

Legal basis: The processing of personal data is necessary to fulfill our contract with you (Article 6.1.b of the GDPR).

Legal Obligations

Purpose: In certain cases, PS Auction needs your personal data to meet legal obligations.

For example, we may use your personal data to combat money laundering and terrorism, to assist competent authorities in their investigations or to comply with tax laws. See more information about each purpose below.

Legal basis: Fulfilling a legal obligation (Article 6.1.c of the GDPR).

Anti-money laundering legislation and combating terrorism
PS Auction must comply with international laws and regulations, such as those concerning combating money laundering. PS Auction is obliged to prevent, recognize, counteract and report money laundering practices. We are therefore obliged to perform KYC (Know-Your-Customer) processes when offering our services to new customers.

PS Auction processes the following personal data for this purpose:

  • Name and address details
  • E-mail address and phone number
  • VAT number (for business account)

Additionally, if you want to finance your purchase using PS Finance, or if we are otherwise required by applicable law to do so, we may also process data regarding your personal identity number and information about your financial situation to be able to do a credit check and verify your identity in connection with this.

Accounting legislation
The processing is necessary to comply with the Accounting Act.

  • Your name, contact details and any other information that appears in accounting materials (e.g. agreements, verifications)
  • Payment history, transactions and other material that constitutes accounting material

Fiscal legislation
PS Auction is obliged to process data of her clients, so that fiscal obligations of PS Auction and the client can be fulfilled. PS Auction is obliged to provide tax authorities with information and to share your data with these authorities. Think here of, but not exclusively, the tax authorities. PS Auction processes the following personal data for this purpose:

  • Name and address details
  • E-mail address and phone number
  • Invoice data
  • VAT number (for business account)

Judicial authorities
PS Auction is obliged to assist and inform judicial authorities. This concerns for example the police, the public prosecutor, courts or supervisory authorities, including but not limited to the Swedish Authority for Privacy Protection (Integritetsskyddsmyndigheten – IMY).

This may include all data collected, processed and stored by PS Auction from you as part of the relationship between you and PS Auction.

Privacy law
PS Auction must also process your personal data, precisely to be able to protect your privacy. PS Auction must be able to react in the right way when you want to use your rights or when the IMY asks us a question.

The Marketing Act
If you have unsubscribed from our mailings, we store your contact details in an "unsubscribe register" to ensure that we do not market to you. This is not personal data that we actively process. We therefore do not look at your data and do not use it for anything except to ensure that you do not receive marketing from us.

Your email address will be in our "unsubscribe register" until you ask us to remove your email address from there.

The processing is necessary to fulfill our obligation according to the Marketing Act to ensure that you do not receive mailings that you asked not to receive, i.e. to fulfill a legal obligation (Article 6.1.c of the GDPR). You need to provide the personal data to us, otherwise we cannot ensure that you stop receiving mailings from us.

Newsletter
The use of your personal data for commercial purposes, such as direct marketing, is covered by this Privacy and Cookie Statement.

PS Auction wants to be able to approach you as a (potential) client and wants to inform you about possibly interesting auctions. This may mean that you can also receive information from the other brands within PS Auction. You will only receive newsletters containing information about our auctions based on your consent. The personal data that PS Auction collects, processes and stores for this purpose are:

  • Name
  • E-mail address
  • Phone number
  • IP address

If you do not wish to continue receiving the newsletter, you can unsubscribe (opt-out). To withdraw your consent, you can use the 'unsubscribe' hyperlink, which you can find at the bottom of our newsletters.

User account

Personal data: For those who have registered a user account, we process your: 

  • personal identification number,
  • bidding and purchase history, and
  • IP address

Purpose: The personal data is processed to manage your user account and facilitate your use of the website. In addition, we save your personal data in a database to facilitate your (future) participation in auction(s).

Functioning of the websites and apps

PS Auction collects, after your acceptance or consent, information about your website- and app-use by means of cookies. This is done with the purpose of providing you with the best possible experience that matches your preferences.

In addition, we process your personal data for the following purposes:

  • If you accept our cookies or if you have created an account, to provide you with specific offers based on your browsing and purchasing behaviour when you have given us permission to do so.
  • To ask for your feedback on a new webpage to optimize the website
  • In case you accept our cookies: to measure your experience in an anonymous way in order to optimize the websites and apps.
  • To carry out audits and security checks in relation to the website
  • Facilitate online auctions on our websites and apps

Communication with you and handling of matters

Purpose: To communicate with you, handle matters if you e.g. complain or else we have a discussion. Your personal data is processed to:

  • Communicate with you and answer your questions if you contact us, regardless of whether you contact us via email or social media. If you contact us via social media, we recommend that you also read the GDPR information provided by the social media platform you use
  • In the unlikely event that we have discussions, legal matters or claims in which you are involved, we also need to process your personal data to handle the matter, e.g. answer your questions and deal with any complaints or legal claims

Personal data: The personal data we process is as follows:

  • Your name
  • Contact details, e.g. your email address and/or phone number
  • Information relevant to the case
  • Your role and information about the company you represent
  • If you communicate with us on social media, we also process information from your profile
  • Other information you provide in connection with our contact

Legal basis: The processing is necessary for our legitimate interest to be able to communicate with you and answer your questions as well as handle complaints and be able to defend ourselves against or initiate any legal claim (a so-called balancing of interests according to Article 6.1.f of the GDPR). By law, we must in certain cases process your personal data, for example if you exercise any of your rights under the GDPR and under consumer legislation. Certain personal data processing is thus necessary to fulfill a legal obligation (Article 6.1.c of the GDPR). You may need to provide us with certain personal data in order for us to fulfill our legal obligations.

Webinars and events

We process your personal data to enable participation in webinars or (online) events.
 

6. From whom do we process personal data and how do we obtain this data?

We process the personal data of anyone who has (had) direct or indirect contact with PS Auction, such as bidders and customers.

We obtain the data directly from you when you visit our websites or other applications and mobile platforms, create an account and enter certain information and when you contact our customer service.
 

7. Personal data we collect automatically

Regardless of whether you participate in one of our auctions, we automatically collect certain information when you visit our websites or other applications and mobile platforms. This includes your IP address or the date and time you logged on to our websites and/or apps.
 

8. Processing of special personal data

PS Auction shall not collect and/or process any special categories of personal data of you, such as race or ethnic origin, political opinions, religious or philosophical convictions, or which show membership of a trade union, genetic data, biometric data with a view to unique identification of a person, data concerning health or data concerning sexual behaviour, as defined in Article 9 of the GDPR.

Sensitive (personal) data, such as creditworthiness, is only required in the case of special lots at auctions, such as aircraft or other expensive goods, to ensure that bidders can actually buy such lots, and to avoid problems with payment and delivery. In some cases, we also work with notaries, lawyers and trustees to meet the legal requirements for the transfer of ownership.
 

9. Security of your data?

PS Auction takes the security of your personal data seriously and so we have taken both technical and organizational measures to protect your personal data.
 

10. How long do we keep your data?

We will not retain your personal data any longer than is necessary for the purpose of processing. After this, the data will be removed as soon as it is no longer needed, taking into account the legal obligation to retain data. For this purpose, the legal basis will be taken as a starting point and the retention period will be tailored to the period during which PS Auction needs the data to achieve the purpose of processing.

For the purpose of bookkeeping, we store, in accordance with applicable accounting legislation, information about our agreement with you for 7 years.

If you have registered an account with us, we will process all your personal data until you unregister your account with us or ask us to delete certain data. However, we review our database yearly to delete accounts that have been inactive for more than 2 years.
 

11. With whom is your data shared and is it transferred outside the EU/EEA??

As a starting point, your data will only be processed by PS Auction and relevant companies in the PS group. We may also partner with other parties to provide you services and will only pass information to third parties that fall within the following scope:

  • Service providers: We commission other companies and individuals to work on our behalf. Examples of service providers include companies that offer delivery services or payment processing (credit card, direct debit and purchase on account), professional bidding agents who act on behalf of customers, advertising agencies and printing firms for marketing purposes e.g. printing and distribution of dispatch, or our internal and external (IT) suppliers. When PS Auction uses the services of third parties, it enters into agreements with these parties, from which no independent obligation arises for them with respect to the processing of personal data. These service providers have access to the personal information necessary to carry out their work (e.g. the delivery of lots). However, they are not permitted to use this data for other purposes.
  • Sellers: Your personal information may be shared with our Sellers. If you make a purchase whereby the lot is shipped to you, we will share your name, address and contact information (phone number and email address) with the Seller so that the shipment can be completed. If you make a purchase where the Seller organizes the pickup day, we will share your name, address and phone number with the Seller so that you can be contacted about the desired pickup time. The Seller may also contact you in case you have an outstanding invoice. Finally, we will share your information with the Seller if you have a complaint about your purchase and PS Auction has not been able to resolve it as part of its mediation role. The Seller will then contact you directly. Please note: If your contact details change during an auction, during a complaint or shortly after a complaint has been resolved, we may provide your 'old' contact details to the Seller if there is reason to believe that this is necessary for the Seller to obtain the rights under the sales contract.
  • In all other cases, you will be informed if your personal data is to be transmitted to third parties and you will be given the opportunity to individually consent to this.

 

For each disclosure we will ensure that the necessary contractual safeguards are in place to protect your personal information.

In all cases where personal data is transferred within the above context to third parties in countries outside the European Economic Area (EEA), we will only transfer the data in accordance with this Privacy and Cookie Statement and applicable privacy protection regulations.

In principle, all data will be processed within the EU wherever possible and will not be exchanged with parties outside the EU. Data may only be exchanged by PS Auction with a non-EU country if the recipient can guarantee the same level of data protection, either on the basis of the legislation in force in that country or through separate agreements as prescribed by the EU in the EU format for a binding agreement.

  • When your personal data is transferred outside the EU/EEA to the USA, this is done with the support of so-called adequacy decisions from the European Commission according to Article 4 of the GDPR. This means that the EU has assessed that a certain country has adequate protection for your personal data. As a result, the EU and the US have entered into an agreement known as the EU-US Data Privacy Framework.
  • For recipients who are not certified according to the EU-US Data Privacy Framework, we may transfer your personal data outside the EU/EEA with the support of standardized data protection regulations adopted by the European Commission. We can also transfer your personal data to a country that the European Commission has assessed as having an adequate level of protection for the processing of personal data.
     

12. What rights do you have regarding your data?

Within the framework of the GDPR, you as a citizen have a number of rights towards PS Auction. After all, it's your personal data. You can invoke these rights by sending an e-mail to gdpr@psauction.com. Requests in which you invoke your rights, acquired under the GDPR, will be dealt with within 30 days. If we are unable to process your request within 30 days, we will respond to you within 30 days with reasons why we are unable to process your request within 30 days. In that case, we will have 90 days to process your request.

  • Right to complain - Article 77 of the GDPR
    You have the right to submit a complaint to the competent supervisory authority if you believe that the processing of your personal data is contrary to the GDPR. In Sweden, the competent supervisory authority is the Swedish Data Protection Agency.
  • Right to withdraw consent – ​​Article 7.3 of the GDPR
    You have the right to withdraw your consent at any time by contacting us. If you choose to consent on the website, you can always revoke your consent directly on the website.
  • Right of access ("the right to register extracts") - Article 15 of the GDPR
    You have the right to receive confirmation of whether or not we are processing your personal data. You can send a request by contacting us. If we process your personal data, you also have the right to receive a copy of the personal data we process as well as information about the processing, e.g. the purposes of the processing and how long the data is saved.
  • Right to object - Article 21 of the GDPR
    You have the right to object at any time to your personal data being processed for direct marketing (including any profiling) and to the processing of your personal data based on a balancing of interests (including any profiling).
  • Right to rectification – Article 16 of the GDPR
    You have the right to have inaccurate personal data concerning you corrected without undue delay. You also have the right to supplement incomplete personal data.
  • Right to erasure ("the right to be forgotten") - Article 17 of the GDPR
    Under certain conditions, you have the right to have your personal data deleted by us without undue delay. For example, if you withdraw your consent and there is no other legal basis for the processing or if the personal data is no longer necessary for the purposes for which it was collected or processed.
  • Right to restriction of processing – Article 18 of the GDPR
    Under certain conditions, you have the right to demand that we limit our processing of your personal data. For example, if you dispute the accuracy of the data, or if the processing is illegal and you object to the deletion of the personal data but instead request a limitation of the use of the data.
  • Right to data portability – Article 20 of the GDPR
    If we process your personal data based on your consent or to fulfill an agreement, you have the right to obtain the personal data concerning you. The right applies to data that you have provided to us in a structured, commonly used and machine-readable format. You also have the right to transfer this personal data to another personal data controller, when it is technically possible.
     

13. Balance of interests

For certain purposes, we process your personal data with the support of a balancing of interests as a legal basis for the processing. In the balance of interests, we have assessed that our legitimate interest in carrying out the processing outweighs your interest and your fundamental rights not to have your personal data processed. 14. What are cookies?

PS Auction places cookies in your browser when you visit one of our websites.

Cookies are small (temporary) text files that are placed to ensure optimal operation of our websites.

Thanks to cookies, you don't have to enter or download the same information every time you come back to us. That's very convenient! In addition, cookies help us understand how you use our website so we can make it better and more customer friendly. For instance, cookies help us collect certain statistics for statistical purposes and to analyse the number of page visits and the popularity of individual pages and subjects. We also use cookies for marketing purposes.

Purpose

Necessary cookies, also known as functional cookies, are cookies that are necessary for our websites and apps to function properly. These cookies are necessary for the performance of our online auction platform. This includes cookies to allow you to log in to our websites and apps, as well as to process your bids or remember your favourite lots. Necessary cookies are necessary for our website to function (ie necessary for a service that you have expressly requested), and no consent is therefore required. Necessary cookies are always placed.

Cookie preferences

Purpose

Preference cookies allow our websites and apps to remember information that affects the behaviour and design of the website, such as your preferred language or the region where you live. Preference cookies are also used to remember your settings when you revisit our websites and apps in the future. This results in faster and easier access, for example because you don't have to log in again.

Preference cookies also help you to select lots and save them in your favourites, so that you can come back to view them later and decide whether to bid on them in the auction. Preference cookies also make it possible to inform you when another user has placed a higher bid than you.

Preference cookies are necessary for our website to function (i.e. necessary for a service that you have expressly requested) and you therefore do not need to consent to them.

Statistics cookies (analytics)

Purpose

Statistics cookies help us understand how our auction platform is used and how we can continue to improve it, by collecting and reporting data anonymously.

Marketing cookies (tracking)

Purpose

We use Marketing cookies to track visitors as they use our websites and apps. The purpose of Marketing Cookies is to display ads that are relevant to the individual user. This makes these ads more valuable to publishers and third party advertisers. These cookies are also known as tracking cookies. Tracking cookies usually involve the processing of personal data. Think for example of the IP-address.

Accept cookies

When you visit our websites and apps for the first time, you will see our cookie consent. With this you can easily accept our cookies. You can indicate for which category of cookies you give or do not give consent for us to use.
